In this privacy policy, I Matthew Barber of 6234 Old Highway 5, Suite D9 PMB167, Woodstock, GA 30188 would like to inform you about the nature, scope, and purpose of personal information I process when you use my Facebook page/group and services. Personal information are all data that can be personally related to you as a data subject (e.g., name, address, e-mail address, user behavior).


First of all, I would like to point out that this policy does not replace Facebook`s Privacy Policy and merely supplements it when you use my offer and services. In accordance with Article 26 of the General Data Protection Regulation (“GDPR”), Facebook (Meta Platform Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland, parent company Meta Platform Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA formerly Facebook) and I are jointly responsible for the processing of your data and enter into a so-called joint controller agreement, which clarifies how the jointly responsible parties will fulfil the obligations arising from the GDPR. Further, your use of the Facebook platform and its functions is your own responsibility, this applies in particular to the use of the interactive functions (e.g., commenting, sharing, rating). In addition, Facebook may use your data for market research, advertising purposes and to create profiles about your usage behaviour and your interests. This allows, for example, advertisements to be placed within and outside the platforms that presumably correspond to your interests. I, as the provider of this policy, do not collect and process any data from your use of my service beyond this. If you contact me by e-mail, your transmitted personal information will be automatically stored for the purpose of processing the request or contacting you. Data processing for the purpose of contacting me is carried out on the basis of your consent (Art. 6 (1) a) GDPR) or, in the case of a (pre-)contractual relationship with me, the initiation of a contractual service (Art. 6 (1) b) GDPR). I delete the data accruing in this context after the storage is no longer necessary for the processing of your request or restrict the processing if there are legal retention obligations.


If you contact me via Facebook`s Messenger, you should note the that the chat history can neither be deleted by me nor by you. For the storage period of the data stored by Facebook, please refer to Facebook`s Privacy Policy. Please also note that a Facebook chat can be encrypted but is not done so by default, and Facebook thus may have access to the contents of our communication. As with the above the legal basis for contacting me using Facebook Messenger is your consent (Art. 6 (1) a) GDPR).


Comments

When you leave comments, you may be able to display certain profile information, share certain details, engage with others, exchange knowledge and insights, post and view relevant content. It’s your choice whether to include sensitive information on your comment and to make that sensitive information public. Please do not post or add personal information to your comment that you would not want to be available. The legal basis for the storage is my legitimate interest (Art. 6 (1) f) GDPR).


Working with me and my services

When requesting my services, it is necessary, among other things, to provide your name, e-mail address and postal address and, if applicable, your payment data, and other details. I process and store the personal information provided when you request my services solely for the purpose of providing you with the ordered service. Accordingly, the data is processed on the basis of our contractual relationship (Art. 6 (1) b) GDPR) as well as to fulfil my legal obligations (Art. 6 (1) c) GDPR).


Disclosure of data to third parties

I will only share your personal information with third parties if:


you have given your express consent to do so (Art. 6 (1) a) GDPR),

the disclosure is necessary for the assertion, exercise or defense of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data (Art. 6 (1) f) GDPR),

in the event that there is a legal obligation for disclosure (Art. 6 (1) c) GDPR), as well as

this is legally permissible and necessary for the processing of contractual relationships with you (Art. 6 (1) b) GDPR).


General technical organizational measures

I have taken a variety of security measures to protect personal information to an appropriate extent and adequately. All information held by me is protected by physical, technical, and procedural measures that limit access to the information to specifically authorized persons and in accordance with the Data Breach Law, the GDPR and this Privacy Policy.

Duration of storage

I store your personal information for as long as necessary to achieve the respective storage purpose. Afterwards, your data will be deleted, unless I am obliged to store it for a longer period of time (Art. 6 (1) c) GDPR) due to tax, commercial or other legal storage or documentation obligations, or you have agreed to a storage beyond this period (Art. 6 (1) a) GDPR).


Rights of the data subject

With regard to your personal information, you have the following rights:


Right to information about the personal information concerned (Art. 15(1) GDPR).

Right to rectification of inaccurate personal information (Art. 16 GDPR).

Right to erasure (right to be forgotten) of personal information (Art. 17 GDPR).

Right to restriction of processing (Art. 18 GDPR).

Right to data portability (Art. 20 GDPR).

Right to object to processing (Art. 21 GDPR).

Right to object at any time to the processing of your personal information for the purposes of advertising and data analysis (Article 21 (3) GDPR).

Right not to be subject to automated decisions, including profiling, (Art. 22 GDPR).

Right to withdraw consent (Art. 7 (3) GDPR) if you have given us consent to process your data.


If you wish to assert one of the above rights, you can contact me at any time. You also have the right to lodge a complaint with a data protection supervisory authority. The Irish Data Protection Commissioner (DPC) is the for the Joint Controllers relationship (between me and Facebook) relevant authority in matters of data protection. You have the right to make a complaint at any time to the DPC (www.dataprotection.ie). We would, however, appreciate the chance to deal with your concerns before you approach the DPC in the first instance.

My Facebook page/group may contain so-called hyperlinks to websites of other providers. When you activate these hyperlinks, you will be redirected from my Facebook page/group directly to the website of the other provider. You will recognize this by the change of URL, among other things. I cannot accept any responsibility for the confidential handling of your data on these third-party websites, as I have no influence on whether these companies comply with applicable data protection regulations. Please inform yourself about the handling of your personal information by these companies directly on these websites.


Accuracy

It is important that the data I hold about you is accurate and current, therefore please keep me informed of any changes to your personal information.


Updating your information

If you believe that the information, I hold about you is inaccurate or that I am no longer entitled to use it and want to request its rectification, deletion, or object to its processing, please do so by contacting me. For your protection and the protection of all of users, I may ask you to provide proof of identity before I can answer your requests.

Personal information and children

My services are aimed at people aged 18 and over. I will not knowingly collect, use, or disclose personal information from minors under the age of 18 without first obtaining consent from a legal guardian through direct offline contact.
